Is s*x with married lady crime

Hi Experts,

Greetings... :)

I have a question in my mind ,so i came here for a discussion.

My question is,

Is having s*x with a married women is a crime.

If this act happens with the mutual understanding of both the parties and the boy is unmarried.

There is absolutely no promise for marrige between them.

In this case who can be considered as  victime.

@Querist,

 

Section 497 of Indian penal code 1860 talks about adultry.

 

Any person(only male) who has s*x with a married woman whose husband is alive and divroce has not taken place is guilty of adutry provided that-

 

1.His husband has not given consent to do so.

 

2.Such adultry must not amount to rape.It means consent of the married woman was a free consent.

 

Therefore,even if the consent of the married woman was obtained,but without his husband consent, will lead you to get yourself trapped under section 497 of IPC.

Agree with Stanley. I also apprciate the response gien by Amit.Giving consent and slapping the guy with 497. This Section 497 IPC  is a blot in our Statue Book.

But how can the lady prove it in the court of law that they had s*x.

And what if the incident happend long back say 1 year back.

Just to help you further, a small clarification I need.


So you want to prove that you had s*x which happnd a year ago?  What is the exact motive of yours?

I am saying on behalf of thet boy.

I wanted to know can that lady /or her husband prove this in the court of law after 1 year that they had s*x.

can they pull that boy to court on this ground.

Only the husband can complain...Has he admitted anything in text,emails...Other than that,unlikely to be evidences

Correct but if only the wife want to trouble the boy??

Hi red,

 

The boy had admitted that he was alone with the lady in the lady's house that to be called by the lady over phone .

Except this  the boy has not admitted anything else.
