Legal notice

i have sent a legal notice to my own relatives in relation to matrimonial problem. i got a reply from their part with certain accusation levied on me. my questions are that:

1. Is it essential to serve again a reply to their reply notice?

2. as their is no time limit mentioned in their reply notice, what should be the limitaion period for making a reply to their reply notice?

3. if an advocate wants to reply on his own pad for his own cause, will this affect the legal proceedings anyway on his side in future?

4. as this is a family matters and my relatives assures me on the phone that they will no do anything wrong again,  therefore, if no reply is given to that reply notice, will it affect my side anyway?

please reply me.. looking forward for your reply.

thanking you

with all due respect ...

any letter sent by one party (though not being a lawyer - i.e. a lay person) to another party = LEGAL NOTICE.

there are no constraints like :

1) the notice should be on printed letterhead

2) the notice should be on Legal Size paper, Leager paper.

3) the notice should bear Seal / Stamp of a lawyer

anything handwritten / coumputer printed, on normal A4 size / even small paper + in any language (mixture of languages is also allowed - eg. Marathi  + English in the same paragraph) = LEGAL NOTICE.

OC as well as the proof of sending + delivery should be preserved.

What would be impact of notice is not replied?

no impact.

u can take ur further steps i.e. - file divorce / JS / RCR ... or u may also send reply to her notice.

but till when u are gonna play the NOTICE - NOTICE game !!

burdon of proving allegations in the wife's notice lies on the wife

Generally notice notice game is played to see if both parties can sit together and solve the issues. Kind of alert before filing any cases.

Amit,

Notice by a layman is "NOT" a LEGAL NOTICE. only an Advocate has right to send a Legal notice, jst having a watch to satisfy those your explainations to call a letter as (=) to legal notice is not appropriate.

Legal notice holds no good if not sent via a lawyer.....If you've recieved a reply posiing allegations then you should reply else it will be deemed to be acccepted.....And may form base for future litigaiton

A legal notice is a notice whereby a party is made aware of  a legal process affecting their rights, obligations or duties..

(Don't play around with laws)....

A notice sent by a person who is not a lawyer is not a 'legal notice'.

ILLEGAL NOTICE ??
