Grand father's property

My mother is from a  village in Ramasamudram mandalam, chittor District. Here is my query, my grandfather has 3 childrens 2 daughters and 1 son. Now the whole property is in my brother-in-laws name. my mother is asking for her share, he is not responsding properly. Can we put a notice like stay order until distributing the property.

dear querist ,

yes,you can get status qua order from the court under O39 Rule 1,2 C.P.C. , i advise your mother to file suit for partition to her share but before filing this few more facts have to known like the full story of the property so feel free to call to get detailed advise.

Being a co-parcener your mother has got share in the property of her father, provided if there is no arrangements have been made by the grand father and if it is ancestral property.

@Rajeev: Yes it is ancestral property and no will excuted.
