My brother & our family has been charged with 498a. My brother has also petitioned for divorce. Can he get divorce on the basis that he & his family have been charged on 498a & now the relations are broken irretrivably.

But it will eventually lead to divorce between parties. Divorce before 498a verdict is of no use to your brother as he neither going to get a eligible girl for re-marriage when 498a is still pending on his head nor he will thus get acquittal from 498a on mere producing divorce decree and also his wife is not a fool to give him divorce wihout return of empty reception nite consumed Johnny Walker bottle now included in 498a as cruelty complaint case so what good these would bring him now think aloud.

agree with tajobsindia.as brother filed for divorce before 498a.so he have to prove grounds mentioned in divorce petition.

But if he gets discharge or acquital for family memebers from 498a then can he make fresh grounds for divorce
