Mutual divorce case

Dear Sir,

My borther was married on 25 dec,2010.After 4 months of marriage he realised that his wife has been cheating on him.He found out the conversation with the person from her mobile memory card itself.They had affair for 2 years,during the courtship period during 5 may to 25 dec 2010 and even after marriage.We have the date and time of the recordings giving this detail.The other person was already married to someone else and had a son.After finding this my brother has talked to the girl and she and her family members came  to take their belongings.We gave the streedhan and also signed a document of putting no aligations on either side and also not demanding any money except the money which was transacted.This all happened on 12 sep 2011.Since the petition was premature a date of 28 may 2012,completion of 1 year was decided by the court to file the first motion for mutual consent.Some of the items given by their family which was to be given as per the document was due on 28 may 2012 but they didn't came and are demanding black money in lakhs......we extended the date to 9 july 2012 and on talking to them it is confirmed that they will not be coming this time also...further they are telling us that they will trasfer the case to the girl's place.....is this possible....?....during the case also and even after signing the documents how can they demand money?

we were first shocked and now facing trouble....can you suggest how can we still keep the place for further process where we have signed the documnets after giving the streedhan.....

9 july is very near....a suggestion can really make a difference as i always believe that if problems can be solved before it arise than that is the best justice one can get.....also everytime we hear that all rules are against husbands....is there something which protect the husband?????

* When your husband's wife was caught red handed with her tail between her legs, she signed the document. Later she realises that she is a woman and is endowed with wholesome rights by the state, she is now trying to extort the situation to her advantage. Don't give in to her unjustified demands. 

* If she refuses to aceede to her promise - file a divorce on grounds of cruelty/adultery.

* File a criminal complaint for adutlery against that guy u/s 497 IPC. 

* Before doing all of this shooting a confidential intimation to all concerned would be a good idea.

rightly said by Mr. Bharat and also can be filed a cheating case against her for not binding the agreement .

Talk to her for Mutual divorce Divorce.

If she threat you than File case of divorce on Qruelty ground. also file case of adultery against that person.

But ultimately you have to get rid of such wife.

If she did not come then demand the court to change the petitoin u/s 13 instead of 13B on the ground of cruelty, adultry and desertion. Dont forget to file case against that guy else she will not bent.

Is 497 non-cognizable act. Can we take a police proceedings for an FIR. for that man. Anyone can help in replying this please. Or just a criminal court proceedings are required, the punishment is upto 5 years.
