Agreement to sale

Hello All

My query is that I am all set to buy a flat in Pune. It is a resale deal. Now the seller has an outstanding loan on that property. Shouldnt this be mentioned in Agreement to sale docuemnt. Please advise.

Dear Asha,

It is the duty of the seller to disclose the encumbrances, if any, over the property proposed to sell in the agreement.

Let him clear the debt.  You can also do onething you can directly credit the amout to the seller
's loan a/c, but prior to do so you get the agreement of sale
