Dowry giver prosecution

There is confusion wrt  Dowry Act....One side it states that dowry givers are prosecuted like dowry takers...

Other side there is Sec 7(3) of the Dowry Act wherein it provides for the protection from prosecution to the person aggrieved by the offence under the Dowry Prohibition Act, 1961

each female & her family who does 498a will always state that dowry is given because its demanded.....(even if that is not true)

In such scenario what is the prosecution so that a case can be filed against "Dowry Givers"

This is sheer abuse of law.. No case is being filed by police against dowry givers till date..That is why it is called gender biased laws.

Government should encourage to file case against 498a Filers, why they gave dowry at first place knowing giving dowry is also crime, then why cry foul if daughter is been harassed for dowry.
So it should work for Both, But sadly our HONEST judiciary do not recognise abetment in Crime i.e. given Dowry

The immunity is only to the informant and not others.

Informant is the de-facto complainant.

 

Like it could be the lady who has lodged the complaint, but all others like parents of the lady, siblings and uncles of the baby who gave dowry won't be immune to prosecution.

Shonee, if the law is so clear is it still not possible to prosecute the givers minus the informant?So many such cases

were dismissed by HCs i guess.

Indeed, they were dismissed. 

 

Because they were not rightly put forth.
