Revocation of gift

Hi all..

 

i am an apprentice, there was a small dispute came around.

 

an eldery person dividing her land through conditional gift deeds, she had revocked two, among them one which were sold in earlier dates. is it possible that registar can revoke with out verifying whether the said gifted land  was sold. how can registar can approve with out intervention of court ??

You have to get court order for such cancellation or revocation

Mr Prasant,

Once the gift was made by the donor infavour of the donee either in any nature like conditional gift or otherwise and the donee accept the same, the donor have no right to revoke the same unless seeking a decree in a proper court of law for revoke the same by showing sufficient change of circumstances.  The Transfer of Property Act itself revels the same.  Hence, the revokation is not a valid one.

Earlier sold one can not be gifted and it will be illegal too.

Dear Mr.Patil,

 

revocation of gift done through registar office is it legal with out intervention of court ? though how can a registar revoke a document after sale considerstaion is done ? does registar has powers to do with out intervention of court
