Can we file a defamation case against the complainant (father of the deceased) ?
Few weeks after registering his complaint the complainant sent my father a letter in his own handwriting and duly signed stating that he regrets his action of filing a case against us . He then submitted affidavits to the concerned police station , ACP , Upper Poice and also in the court during the bail application of my brother(husband) . The trials have started and now he is going back on his words and is making false allegations again but this time only against my brother. Dying declaration is totally in our favor but it was taken in her parent's absence . All the allegations are baseless and false . There is nothing in the chargesheet that goes against us.
