Is married son may be eligible for compassionate appointmem

A boy aged 28 (married) applied for job under the die in harness scheme. His father was working with a Public sector organization. the father passed away while he was in service. It was only 2 months left to complete his service in the organization. 

  According to the company's memorandum, only unmarried  and dependent son/daughter is eligible for  the job. Due to this reason, the management  rejected his application for the job. even if they don't offer the job, does the company is obliged to pay death benefit to the family. No one in the family is employed. if they go for filing a petition against the organization, will it succeed 

can anybody explain " die-in-harness scheme".

The purpose of providing employment assistance to dependant of the employee dying in harness is to provide finanial support to the family. Hence conditions are laid by the employer, which the employee or his dependants cannot change.  Married son or married daughter is excluded in the definition of the dependants because they have their own families. 

Any one member of the family may apply with the consent of other family members.

Pl get a copy of the rules of employment to dependants of employees dying in harness and study it carefully.

It varies from organisation to organisation depending upon the service rules applicable. 

Please talk to the Officer in charge of the section and do as per his advice.
