6 months waiting period waiver for mcd

Hello everyone,

Is there any clause that can help in waiving of the 6 month waiting period for divroce when mutual consent application has been filed in a Family Court?

No, as per the decision of the SC, the 6m period cannot be waived.

Yes,Adv Archana is right as per the latest judgment of SC you have to wait for 6 months.

Thanks. When a monthly maintenance is being agreed to be paid + a lumpsump amount as FD, when should I start paying it.......on approval of divorce? Also can you please advise what should be the contents of MCD...such as no more legal issues to be created, wont apply for increase in maintenance etc...

As per the terms of MCD only.

If it stated from the date of divorce then on divorce.

If it stated from the date of presentation of the case, then right now.
