Filing rti?

Hi All,

Unfortunately, the site that I own is encroached by someone else.  I wanted to check, if the site, really belonged to me. Please let me know, as how do I file a RTI, inorder to prove, if the site really belonged to me?

 

Please help.  Additionally, can I file RTI in internet?  Kindly share the details.

First and foremost you have to clear the following facts:

1. When did you purchase the site?

2. Whether the Sale deed has been executed in your favour and if so when?

3. Whether you have the Registered Sale Deed with you?

4. Did you ever get the possession of the site?

5. When did you last see the site when it was not encroached?

6. Where is the site located, including the State?\

7. Have you already initiated any legal action or any other action and if so the details thereof.

First and foremost you have to clear the following facts:

1. When did you purchase the site?

[Sunil Kumar] I purchased in May 2006

2. Whether the Sale deed has been executed in your favour and if so when?

[Sunil Kumar] Sale deed has been executed in my favour in May 2006.

3. Whether you have the Registered Sale Deed with you?

 

 

[Sunil Kumar] I have take a loan from bank and hence its with bank.

 

4. Did you ever get the possession of the site?

 

 

[Sunil Kumar] Yes, I did have posession of the site(vacant land).  Please note that there is nothing contructed yet.

 

5. When did you last see the site when it was not encroached?

 

 

[Sunil Kumar] I keep visiting the site once in 6 months.  Initially the encroached party had built a comount wall. Guess atleast around 2 yrs back and now the compound wall, no more exists.

 

6. Where is the site located, including the State?\

[Sunil Kumar] It is located in Bangalore, Karnataka state

7. Have you already initiated any legal action or any other action and if so the details thereof.

 

 

[Sunil Kumar] I am yet to take a legal action.

I hope that except raising 0the compound wall, nobody else is residing inside the plot, by having hut etc.

If nobody is living inside, then it would be advisable for you to first put a hut inside, appoint some chowkidar and ask him to be in charge. 

If the situation/scenario is something different, then it would be adviseable for you to get in touch with a local lawyer and to take appropriate immediate action, before it becomes too delayed.

Thanks sir.  By the way, do we have an law that states that the case has to be filed within x number of years of encroachment?  If yes, can you please share the details?

FTI is absolutely no solution to your problem and you will only be wasting your  precious time and it will be advantageous to the encroacher.
