Need advice on Counselling

Am Prakash, My wife went away from me couple of years back. I have a kid of 7.5 yrs. old. I filed RCR in Pondicherry court 8 months before. My wife haven't responded for my petition. I also got an order favouring my prayers. Then i filed Child Custody petition. For the past couple i haven't turnup as i was in DK. Mean while we (Myself and my lawyer) were waiting for her to file the counter. But this time she responded by comming to the court with her lawyer. This month on Tuesday (15th Feb. 2011) i went to the court. She didnt come. Instead her lawyer appeared and he said to the Judge that they need a counselling. The judge accepted it and gave a date on 16th Mar. 2011.

Now how this will end, does it mean that my wife is interested to come back to me. I love her a lot and i want her to be with me (along with the kid) OR will there be any other plan made by her lawyer. How should i go further, PLEASE ADVICE?

Counseling to resolve a couple's issues done by a trained person if presented briefs to be taken as background is always a better approach to have a happy married life.

As you say you have no acrimony with your wife and want to have a happy family with both of your kid. However there might have happened something in between you two that made her leave marital home and you could not have recognize that minor sign. Her not contesting your RCR (restitution of conjugal rites) and child is with you and when you further probed her with a child custody suit she requesting for 'counseling' seems to be all positive going wise.

1
. Have positive outlook to these developments and face the counseling sessions to iron out minor tiffs between you both while listening as in listening to her 'personal' you know and I mean 'that personal' minor issue she wants you to take care of with the help of a councilor.

2
. Some ladies prefer presence of a Lawyer as these ladies are not in-tune with court setups and probably stepping in for the first time to such concrete intimidating structures. Hence a support she is carrying in case she needs minor legal push ups on the go:-)

3. Keep your options open but with a little here and there as in little give-in/little take-in attitude during counseling sessions and if you see an opportunity striking then go for the grab before a family breaks to a un-returnable point and here in these circumstances you shall be the judge yourself, afterall, the child is both of yours as well as she is your better-half too further as much as you are her only support after marriage in a matrimonial home.

4.
A trained councilor may help both of you resolve the minor hiccups till date and nothing wrong in such approach. Family Courts established across various Districts in India have these facilities to help couples retain their marriage.

All the best.

Good luck!

Try to know why she left the home. Then sort out the issue.

And I salute you for your unconditional love for your wife and kid.

Dear Sir,

Thanks for your reply. I felt happy when her lawyer requested for a Counselling, but i had few issues in my mind as am not sure why she is requesting for the counselling when she didn't turn up for the RCR. Now am so happy to get a positive feedback from you. I will face this counselling very positively and i will defenitely grab this oppertunity when and where required.

Regards

Prakash R

What exactly is Counselling, is it effective. What they will do? The seperation in my life happened only because of my Mother in-law. We are love marriage. Am from a Brahmin family and she is from a Chiristian family. Will my M-I-L allowed to speak in counselling, because if she speaks then i know it wouldn't go well. Because she will say that both my wife and son will be with her in Pondicherry. Am working in Chennai (140Kms. far) and i can come and see them on week ends. Which i dont wanted to do. I want my family to be with me. Kindly suggest what should i do in this context.

What you want is very reasonable. Make a request that you need councelling sessions wihtout the interference of your mother in law. In the initial councelling sessions, no relatives would be particularly called. If you MIL accompnies your wife, make a request to the councellor that you want session only with two of you.

Do not say no to your MIL's participation in later session. In one way it would be good becasue the councellor would provide councelling to your MIL also, which it seems she really needs in your case( I assume what you are saying is true).

All depends on how good and experienced the coucelor is. ...

Counceling is effective when couple have open mind and both of them want to give thier marriage a chance. It gives you time and space to iron out your differences and know about where exactly the relationship is hurtful for both of you.

It is not effective if one or both of the couples are adamant on parting thier ways...

Wish you the best
