There are many anomalies and irregularities being seen in a civil suit as follows:-
Petitioner and his ld. counsel......submitted few docs and its list of docs. (It happened a few times in due course) Everytime only copy of docs is given to other side except index page i.e. list of docs. Other side/resopndent also...had filed docs on many hearings with permission and given a full set to other party.
Yesterday we applied for certified copy of many Exh.
But while applying for certified copy of the same it is revealed that ... some docs/proofs aren't given the Exh nos at all, and its list/index page only is given the exh. no. ..and Hence certified copy of those docs couldn't be obtained (only index page/list was sent for xeroxing!!) because they don't bear any exh no....weird isn't it?
Also the Applications submitted on the 4th Jan 2011, and also on 5th and 7th (by making a written request to 'take the matter on board' on those days. for filing of important injuction apps) ..... were not even given Exh. nos and Also Hon court didn't signe those apps as 'ordered' or 'O' as admitted till today!!! ...... It should have 'ordered' atleast as 'O/Admitted' for further proceedings and for 'say on exh ' by petitioner!!
Can anyne advise what's probably happening out here!!
Can the Hon'ble Court prefer NOT to sign the applications on the same day?...is it under discretionary powers of the Hon'ble Court?
Hearing, scheduled on on 21st Jan 2011, was adjourned (Petitioner's ld counsel absent for sickness)
As of today, the Application submitted on 4th, 5th, 7th are lying without any sign of the Hon Court.
