New Delhi, Nov 24(PTI) The 2G scam has put "all other scams to shame" the Supreme Court today said, brushing aside Centre''s argument that it should not monitor the case and Subramaniam Swamy''s letter to the Prime Minister cannot be treated as a complaint. A Bench of Justices G S Singhvi and A K Ganguly made some sharp comments while reserving its judgement on Swamy''s plea for a direction to the Prime Minister to grant sanction for prosecution of former Telecom Minister A Raja in the scam.

"The Prime Minister did not take it lightly, obviously he was concerned," the Bench observed when Vahanvati repeatedly asserted that Swamy''s plea was only in the form of a letter and cannot be considered as a complaint. "Your written submission never said that the petitioner did not file a proper complaint.

We don''t need to tell the learned Attorney General the subtle distinction," the Bench quipped. The Bench pointed out that no such argument was taken in the affidavit filed on behalf of the Prime Minister.

However, the AG stuck to his argument and said that, "I filed the affidavit on the same facts." But the arguments failed to convince the court.

"According to you it was not a complaint but a letter. Whatever, it is, it was open to the sanctioning authority to say the letter is not in proper form.

"In this case if Dr swamy''s letter was not in the form of complaint you should have said it. Why shall he a file a complaint at all when the court cannot take notice of the complaint," the Bench asked.

Admitting that it was not there in the written submission, the AG said, "I apologise." "Affidavit filed on behalf of the sanctioning authority (Prime Minister) also did not say that that it was not a complaint but a letter.

Otherwise, you should have filed a one-paragraph affidavit saying that the letter does not merit action as it was not in a proper complaint form," the Bench observed. The Bench also brushed aside the CBI''s plea that the apex Court should refrain from further monitoring the case as the investigation had been taken up by CBI and other agencies.

"If you go into the monetary aspect. This scam will put all other scams in the country into shame,"the Bench observed.

This scam is in Top I now until next one comes. Always in India scams will come out to get first place.

I had received message that " at lastManmohan singh opened his mouth and said that he knows about 2G, one is  First one is Soina Gandhi and 2nd one is Rahul Gandhi.

No party is clean. Look at the way 2G scam has been investigated by Congress and look at the way BJP consented CM of Karnataka to continue in spite of land grabbing allegations....   :(

It is true that No party is clean. But everyone right from Sonia Rahul to PM himself has kept quite, everyone is trying to hide the facts shamelessly. At least they must respect court.

If the people sitting at the helm of affair, will behave in such a manner, then what will happen to the general mass.

Every time court is intervening and even court too is facing problem due to scamsters.

U r right Adv. Rajeev sir,

Present situation is like this only (" Kallara Sante" ),

Sonia Gandhi is in the list of Forbes most powerful/influential leaders/persons and is all in all in Congress, which is a ruling party. People has always favored Congress and in spite of favorable condition, she along with other has kept quiet, so what does it mean. She even does not denounce corruption.

Also in the past even HC's observation was used to be more than sufficient to shake entire bureaucracy/executive and Politicians. But now no one is taking the note/observation of even Hon SC.

Is this way country will be run?

SC ticks off CBI for not questioning Raja

 New Delhi, Nov 25, PTI:
The Supreme Court on Thursday gave a dressing down to the CBI for not questioning former Telecom Minister A Raja and Telecom Secretary in the 2G spectrum scam, saying the agency was 'beating around the bush' when 'illegality is prima facie evident.'
 
A Bench of Justices G S Singhvi and A K Ganguly during the fag-end of the day-long hearing castigated the country’s premier investigating agency for failing to examine the duo, which was “minimum expected” of it since the criticism had come from the CAG, a Constitutional authority. “You said 8,000 documents had been examined still you are beating around the bush. It was minimum (questioning the duo) expected of the CBI,” the court said.

In its defence, the CBI offered to place a status report on Tuesday before the apex court which would also take on record the CAG report placed by the Centre for Public Interest Litigation counsel Prashant Bhushan.

“The CAG reports deserved highest respect. If such an authority set up under the constitution gives such a report any reasonable person will question the minister and the secretary,” the court said. The judges, who on an earlier occasion too had pulled up the CBI for its “slip-shod” investigations, said that “illegality is prima facie evident. This is the reason there is an FIR. We think the gentleman’s (apparent reference to Raja) involvement is replete with details. Has that gentleman been examined?” the Bench asked.

To which, CBI senior counsel Venugopal contended that the agency was examining various documents and assured that none would be spared once their involvement was established. However, the apex court ticked off the probe agency by saying that when even the press have decoded the documents, why has the CBI failed to question those involved in it. 

Slamming the CBI, the court noted that the transfer of the licenses by Swan Telecom and Unitech Wireless LTD, alone has deprived the state exchequer of Rs 9,000 crore. “Unitech and Swan Technologies got licenses and transferred it to other entities within a few days for Rs 5,000-6,000 crore. It could have brought upto Rs 9,000 crore (to the government). “The CBI had this information before it. These two instances in the report is self speaking,” it said.

SC bench ‘managed’, alleges letter

 New Delhi, Nov 24, PTI:
The Supreme Court Bench which is hearing the 2G spectrum scam on Wednesday disclosed that it has received an anonymous letter stating that the court 'is being managed' in the case.
“An anonymous letter has come to us. The allegations are that we are being managed,” the Bench comprising justices G S Singhvi and A K Ganguly said during the hearing of the petition seeking monitoring of the investigation into the scam.

“The letter has been put in the office report. The content of the letter has become part of the office report. That anonymous letter is part of the office record now. The allegations are that we have been managed,” the Bench said. “You (advocates appearing in the case) can get a copy of it,” it said.

While the Bench was making reference of the letter, Solicitor General Gopal Subramanium, senior advocates K K Venugopal and T R Andhyarujina appearing for the CBI and former telecom minister A Raja suggested that the Bench should ignore such a letter and throw it in the basket. “I have thrown it in the basket. I had got it in my dak at my home,” Justice Ganguly said.

Yes Adv. Rajiv Sir I have heard of that book but I will try to find out the book.

here the present situation is grave.

 

In Monica Lewinski episode, President Bill Clinton was lying and was defending himself everywhere, but when he faced Grand Jury he admitted every allegation and didn’t lie. One of his party senate when asked in the Interview by a Journalist that “What if the President lie here also?” then the senate replied a liar cannot be our president and we will not accept him. But The President kept the sanctity of Grand Jury up.

But what happening here is just opposite. If the govt. and it’s institutions and staffs will not abide by and keep the sanctity of the court then who else will.
