Our constitution is Questionable

I read somewhere that our constitution was prepared as if a creature is prepared taking arms from one animal,legs from another animal, head from some other animal, torso from some other animal.


Thus this creature is having all the body parts but having NO LIFE.


Please give your precious comments.


Also note that this post is not to hurt anybody's feelings,apology incorporated beforehandedly, if someone gets hurt.

I advise you to make an effort to study our Constitution to know it better being an Indian and then come here to know about its flaws and good aspects.

I disagree that 'this creature has no life'. Surely printed words cannot have life,but the writers have poured their sould into it,so while reading, soul emerges from the book and touches our heart.So it is not the book that will lead you,but it is the spirit which words carries. If I cannot see,does not mean that things do not exist.You worship the constitution and constituion will give you boon.

THE CONSTITUTION OF INDIA 

Preamble

WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a _1[SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC] and to secure to all its citizens:

JUSTICE, social, economic and political;

LIBERTY of thought, expression, belief, faith and worship;

EQUALITY of status and of opportunity;

and to promote among them all

FRATERNITY assuring the dignity of the individual and the _2[unity and integrity of the Nation];

IN OUR CONSTITUENT ASSEMBLY this twenty-sixth day of November, 1949, do HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION.



PART IVA

FUNDAMENTAL DUTIES

_45[ 51A.  Fundamental Duties of citizens.-

It shall be the duty of every citizens of India-

(a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;

(b) to cherish and follow the noble ideals which inspired our national struggle for freedom;

(c) to uphold and protect the sovereignty, unity and integrity of India;

(d) to defend the country and render national service when called upon to do so;

(e) to promote harmony and the spirit of common brotherhood amongst all the people of India transcending religious, linguistic and regional or sectional diversities; to renounce practices derogatory to the dignity of women;

(f) to value and preserve the rich heritage of our composite culture;

(g) to protect and improve the natural environment including forests, lakes, rivers and wild life, and to have compassion for living creatures;

(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;

(i) to safeguard public property and to abjure violence;

(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.]

 

WHO DO NOT FOLLOW THIS THEY ARE ANIMALS AND NEITHER THEY DESERVE TO BE A INDIAN NOR THEY ARE A HUMAN.

I agree with Arup, that harsh approach should be avoided. Moreover it appears the author wanted a intellectual discussion not a mud slinging at each other by getting defensive. If any document is sound enough then there should not be any problem discussing, scrutinizing or analysing it openly. In a democracy every divergent or uncommon view should have the right to express opinions. Everyone should try to understand, appreciate each others views by keeping one's personal biases and prejudices of mind aside. While surfing the net for material related to the topic of this discussion I came across some surprising opinions. (1) The State shall not discriminate against any citizen on grounds only of religion, race, caste, s*x,

place of birth or any of them.

 

(2) No citizen shall, on grounds only of religion, race, caste, s*x, place of birth or any of them, be subject to any disability, liability, restriction or condition with regard to-

 

(a) access to shops, public restaurants, hotels and places of public

entertainment; or

 

(b) the use of wells, tanks, bathing ghats, roads and places of public resort maintained wholly or partly out of State funds or dedicated to the use of the general public.

 

 

(3) Nothing in this article shall prevent the State from making any special provision for women and children.

 

_10[(4) Nothing in this article or in clause (2) of article 29 shall prevent the State from making any special provision for the advancement of any socially and educationally backward classes of citizens or for the Scheduled Castes and the Scheduled Tribes.]

Right to Equality

 

ART 14.

 

The State shall not deny to any person

Equality before the law or

The equal protection of the laws

Within the territory of India.

 

ART 15.

Look at the art 15 (1) where The State promising not to discriminate - on grounds only of

religion,

race,

caste,

s*x,

place of birth

or any of them. 

 

Now check art 15 (3, 4, & 5) which opposes the provisions of art 15 (1).

THEN WHAT IS THE USE OF ART 15 (1)?

AND IF, ART 15(1) NOT THERE, 15 (3,4 & 5) ALSO NEED NOT BE THERE.

WHAT GOVT DOING, LET IT TO BE DONE BY THEM.

 WHY THIS ART 15 IS THERE WHAT THE PURPOSE IT SERVING?
