AGRICULTURAL LAND ALLOTTED BY GOVERNMENT TO CHARITABLE TRUST

AGRICULTURAL LAND OF 16 ACRES ALLOTTED TO ONE REGISTERED  PUBLIC TRUST IN SANGLI. THE MUTATION ENTRY IS MADE ON 7/12 EXTRACT OF THE LAND. THE TRUST IS QUITE OLD AND IT IS NOT KNOWN ON WHAT DATE AND YEAR THE LAND WAS GIVEN TO THE PUBLIC TRUST FOR ATTAINING ITS CHARITABLE OBJECTS BY THE GOVERNMENT OF MAHARASHTRA. WE HAVE TRIED OUR BEST TO TAKE SEARCH OF THE GOVERNMENT ORDER OR GOVERNMENT RESOLUTION FOR ALLOTTING THE LAND. IN THE RECORD OF THE PUBLIC TRUSTS REGISTRATION OFFICE, SANGLI REGION, SANGLI THE LAND WAS NOT MENTIONED THAT THE LAND BELONGS TO THE TRUST, WHICH WAS GIVEN BY THE GOVERNMENT TO THE TRUST. EVEN WE HAVE TRIED TO TAKE SEARCH IN MANTRALAYA, DEPARTMENT OF REVENUE, BUT, IN VAIN. WITHOUT PRODUCING THE COPY OF THE GOVERNMENT ORDER / RESOLUTION THE OFFICE OF THE ASSISTANT CHARITY COMMISSIONER, SANGLI IS NOT READY TO TAKE THE NOTE OF ENTRY OF LAND BELONGING TO THE TRUST. ANY ONE COULD HELP US HOW TO GET THE GOVERNMENT ORDER OF GOVT.RESOLUTION FROM PROPER SOURCE.THE TALATHI, CIRCLE INSPECTOR, TAHASILDAR AND THE COLLECTOR OFFICES SAID THAT THEY DO NOT HAVE THE COPY OF THE ORDER. EVEN THE REVENUE DIVISIONAL COMMISSIONER, PUNE ALSO SAID THEY DO NOT HAVE ANY RECROD OF ALLOTMENT OF THE LAND TO THE PUBLIC TRUST. KINDLY SUGGEST THE WAYS AND MENAS TO DO THE NEEDUL IN THIS MATTER.

1.  File an RTI application with the Charity Commissioner (Sangli) asking for copies of Balance Sheet + P&L + All schedules + Audit Report of the said Trust, for the last 10 years.  Because the Trust is a "Public Trust" and because the  govt. had alloted land to the trust for charitable objects (which again pertains to the larger interest of the public),  the Charity commissioner is bound to provide you the info.

 

2.  Locate the survey number and the plot no. (gat no.) from the 7x12 extract and obtain the Form no. 6,  from the Talathi office or the Tahsildar's office.  From this form no. 6,  you will be able to find out the date on which the specific plot was given to the Public Trust.

 

3.  Find out the current status of the charitable activity being conducted on the said govt. plot.  Obtain 7x12 extracts of all the four side neighbouring plots of the said govt. plot being used by the Trust.
