RCR

What woud be the charges to file a RCR & can we file as an individual, if  so what woud be the charges.

If not what would be the fess for lawyer & RCR petetion

YES. CHARGES ARE VERY NOMINAL IN CASE OF PETITIONER IN PERSON.

Hello Ld Members,

Finally i have filed my RCR on my own i got date this 8th Nov ' 2010.

Before this i tried for a mediation through third parties from the other(wife family members & relatives) party.

but no response.

My Question:

  • I(Court) did not receive the acknowledgement card by  the other party(wife side)
  • Will the other party attend
  • What would the questions from the judge
  • What would be the counters from the lwyer of the other party.
  • Is there any thing that i had to prepare for the first  hearing of my RCR 

 

Your answers would be appreciated asap from the respected forum members

as i am very close to the date

RCR IS AN EFFECTIVE TOOL FOR HUSBANDS TO ASK TO JOIN OR TO GIVE JUDICIAL SEPARATION.

YOU DID A GOOD JOB, FOR ANY HELP LCI IS ALWAYS WITH YOU.

Dear All,

My friend's marriage was perfomed under Indian christian marriage act.

His wife deserted him without any reason after three months of marriage.she had taken her all her belongings.Parents of my friend mediate through elders several times but there is no response till now.. now she had given birth to a baby.. she/her parents even did not tell him about this... 

She is a adamant,aggresive,liar,uses abusive language,money minded,ego etc...Her father know that cause of all mess is created by her, they know her behavior well but not ready for talk.

He didn't file a case with police station after deserting him. Can he file now? it is almost 6 months.

It is advisable to file RCR for the sake of new baby?

What would be consequnces if she does not respond?

Dear ld. members

My first date for RCR petition got postponed for TEN days later, as the family court judge was absent.

Now i came to know that, my wife's laweyer filed 408 on me. This happened after filing my RCR petition.

My Que:

What is this 408 section is it IPC, CrPC, or CPC?

However, how to go further with this 408 case, which is filed?

WHAT YOU HEARD IS WRONG, 408 CR.P.C IS TRANSFER OF CR.CASES FROM ONE COURT TO ANOTHER UNDER SAME JURISDICTION OF SESSIONS/HC.

Dear Members, 

I got exparty divorce decree (@ district court/lower court), jurisdiction is my wife's parental home.

This exparty divorce decree is without my intimation, prior to that i filed RCR @ my matrimonial home jurisdiction, my wife received my RCR notice from court but I did not receive the acknowledgement.

Q):-

·         Will the divorce decree be valid, even though after filing RCR before the judgement declared.

·         What shoudl i do,  shall I file condone delay petition, revised petition or any other better solutions.

·         if so in which court,  the same court where I got the expartee divorce decree, or in Sessions Court of same jurisdiction or  HC 

·         In how many days before I have to file the said petitions from the date of the judgement declared by the sadi court.

·         Even though after the expartee divorce decree judgement declared.....

      why did my wife’s lawyer filed 408 CrPc on me, as I don’t have any other cases on me. Does he know  that the judgement is void, as I filed RCR?

Hai all,

My wife did not attend for 2 consecutive adjournments,

then judge told she will give expartee and asked me to submit me the affidavit

now my doubt is ... what would the affidavit(draft) contain about.

my next adjournament is next week

I MEANT THAT YOUR AFFIDAVIT WOULD MOST CONTAIN THE FACTS THAT YOU HAVE WRITTEN IN YOUR RCR PETITION. BUT I AM NOT VERY SURE EXACTLY. DEAR ADVOCATES WILL GIVE YOU THE REQUIRED ANSWER
