Case filed on the name of society but there is no such society registered under any society act.. any judgements citation relating this?

A society, whether registered or unregistered, is a compendium of it's members.  Members are the representatives of a society without whom, the society doesn't have an identity of its own. 

An unregistered society is not a legal entity and thus cannot be sued.  However, you can file a representative suit under Order I Rule 8 of the Code of Civil Procedure and sue the members of the unregistered society.
