Case filed on the name of society but there is no such society registered under any society act.. any judgements citation relating this?

Petition filed on the name of society but there is no such society registered under any society act or any other law.. need judgements related this and important points if anyone can help plz.

Hi,

A society, whether registered or unregistered, is a compendium of it's members.  Members are the representatives of a society without whom, the society doesn't have an identity of its own. 

An unregistered society is not a legal entity and thus cannot be sued.  However, you can file a representative suit under Order I Rule 8 of the Code of Civil Procedure and sue the members of the unregistered society.
