Wife cannot use her husband's surname after divorce

A woman cannot use her husbabd's surname after divorce. This divorcee argued in the Supreme Court that a sir name is not a patent.Suprreme Court dismissed her petition/case:

Good divorcee should not be allowed to mis-use surname of her husband at all.

This is a good decision.

We already forecasted our views almost 1 month back on this erstwhile news item published from Mumbai and I am not surprised to see admission stage itself Order by Apex Court in right interpretation of Art. 21 COI

MRA's (Mens Rights Activists) reading this post should congratulate fighting for RIGHTS spirit of this HUSBAND to contest issue on usage of his surname post divorce by ex wife all the way to
Apex Court. That should be fighting spirit for your rights and not struck to duties which Indian metro wives file cases only for in the name of Art. 21 COI.

WHAT IF SHE WILLINGLY DO AFFIDAVIT THAT SHE HAS CHANGED HER NAME FROM RUHI SINGH TO RUHI MALHOTRA.(AFTER DIVORCE AND IF HER HUSBAND'S SURNAME IS MALHOTRA???

surname is different from plain name. THIS DENOTE / SIGINIFY FAMILY'S NAME. surname we get from father. In old times,even married women never suffixed husband's surname. hence they add suffix devi or bai etc according to custome. adding husband's surname is modern day concept and willingly gifted by husband to sgnify that girl is now part of HIS family. still lot of difficulties in changing name in school certificates,passport etc.

if wife retain husband's name after   divorece this means she is ashamed of her paternal family's name by taking divorce or she changed her "Baap" or some commercial reasons like bhojpuri filmi heroins who changed their original surnames and suffixed non-bhojpuri surnames for 'garma garam' roles. typical in your case where malhotra is more marketable than singh.
