And all evidence shows absconder is innocent.

Even if person is innocent even then such innocence is required to be proved in court of law. Absconding from law is not a solution. Court shall proceed u/s. 82 & 83 Cr. P. C. and to proceed the accused absconder.

Dear Mr. Farhan Riaz,

                                 Once an FIR is registred the due process would be to file either for a anticipatory bail or surrender before the concerned jurisdictional metropoolitan magistrate and then file your bail application under section 4436 of Cr.pc.

In your case what i understand is that though the said accused/respondent is innocent in your opinioon and view it still has to be rpoved before the court through the process of trial.onr needs to undergo the trial proceedings as per the criminal procedure code which is laid down and then you c an rpove your innocence in what so ever manner based upon your evidence and witnesses.

aIt is not good in the eyes of law if one who is arrqaaigend as an accused absconds, infact it is the duty of the police to bring it to the notice of the court if one absconds,The police can still track and arrest the absconder.
