VERBAL INSTRUCTIONS

To all the August Gathering

I wish to know from all the Gentlemen/ Ladieson the abuse of verbal instruction

Normally in any corporate, there are many verbal instructions issued by the Bosses.  A Junior has to abide by them else face action under the Disciplinary Rules.  The Junior has not undergone any training session and was asked to carry out certain jobs.  It was also found that there was no laid down system for carrying out this particular activity.  Lately it was found that the Jobs asked by the Boss , were illegal and a case was registered against the Junior.  

 

What is the recourse left to the Junior. Please reply on vivek712@indiatimes.com

There is something called vicarious liability which can be thrust on the bosses .... if the acts done by the Junior fall in the line of duty ... But if these acts were not done for the company/firm and were done in personal capacity then the Junior is responsible for such acts ...

the boss is responsible for the conduct of his junior. one must able to establish that Junior has got instructions from his superior. the Junior can prove the same by gathering some proof that his boss given instructions (witness, some communications, work report etc),  and that his boss made some arragement to facilitate the junior to conduct the job and also to prove that been well aware of the job done by the junior.

 

The Superior  has not taken any objection even though he was well aware of the conduct of the junior may establish that it was instructed and supported by the Superior and his conduct shows verbal and implicit approval to the job of the junior.
