Special rights of Mortgagor in usufructuary mortage under sec 62 of TP Act and weather mortagagee can file declaratiuon.
Mortgage was done in 1942 and possessioin was retainrd by the Mortgagor, and Co-operatice society loan by Mortgagor
Now mortgagor filed the declaration suit against the mortgagee,, is irt servive

If the loan for which the mortgage is done iscleared, the society will clear the mortgage. Else, the society is at liberty to bring it for sale. No limitaion will apply in this case.
