Uncounted money

Hi, 

Can a accused can get benefit , if complainant advanced uncounted moneny which is just part of total loan amount.

Dear mr ashish your question is little bit confusing

is it uncounted money or un accounted money ?

if it is un accounted money the accused will make it as a point and it is the ability of the plaintiff's advocate to

nullify this matter during the argument.

Complainant ( Money lendor) claimed in his claim that he had advanced a loan of Rs.5.00 lacs to accused , he could explain in cross only source of Rs. 3.00 lacs but he agreed balance amount is uncounted money . but cheque amount in case  is for complete amount of Rs. 5.00 lacs . What benefit is available with accused on account of uncounted money ? Pl with some decided case.

Do your home work properly for cross and bring on record all such things as=

1) un accounted money.

2) No financial capacity.

3) No real trasection.

4) No earlier history.

5) and most important try to show that they did not have any earlier dealings so how complainant has trusted the accused.

AND YOU CAN EASILY WIN THE CASE., ANY SLIP IN CROSS WILL BE DAMAGING.
