Un identifying the accused by eye witness

Dear learned counsels in one of the criminal case durin the trail eye witness did not identified the accused inspite of his presence in the court witness deposed tat particular accused s not before the court.. How can i take it as my defence n s ther any citation wit refer to tat so tat i can strengthen my case ple do the needfull

yes my friend it is a crucial for you becuse an eyewitness has been hostile and given the statment befor the public prosecutor that main accused is not before the court u can make argue before the court.

please let us know for which part you are appearing. if you are appearing for the accused and the eye witness turned hostile, it is good for you and if you are conducting for the de facto complainant, you can declare the eye witness as hostile and do the corss examination as well.
