Tri party transfer

Hello,

I have come across a property (flat) with the following details

1. Status of Construction - ready to move (occupating certificate received).

2. Parties involved ( Builder, 1st owner and Me).

3. Title (1st owner dint registered the property, however, hold agreement of sale with Builder).

4. Payments made (only a portion of entire property value is paid a year back listed as per agreement of sale, and no additional amounts paid by 1st owner to Builder).

My question is, can I get into an agreement with the Builder and 1st owner of the property and register the property in my name. (i.e., transfer from Builder to me) and does that stand legal? 

Upon my discussion with bank personnel, they will transfer the funds upon agreed between Builder and 1st owner mentioned in MoU between me and 1st owner. Please advise.
