Tresspassing & injunction

Hi,

I have land registered on my name along with possession with compound wall. I also kept board as 'land belongs to sharath and trespassers will be prosecuted'. To what extent, my property is safe.

In theory you are quite safe as the law is on your side. But in practice just the opposite is the case. We have still got remnants of the legacy and mindset of Socialism. Under Socialism there is no respect for right to property. You must keep constant surveillance on the property, if necessary  appointing a security. If there is an encroachment or trespassing and if you go to the police to file a criminal complaint or an FIR, the police will try to escape saying that it is a civil case. So be watchful and if there is any trespassing first complain to the police and if they do not act file a complaint with the magistrate having jurisdiction. Time is the essence of such action. Any delay will compromise your rights.

Most important thing is do not keep the land unused for long.

Anybody with malicious intention can remove your board or paint it with his name. Follow advice of Dr Ramani
