I'm willing to buy a flat which comes in Scheduled Caste (Reserved Category flat) in Andheri (Mumbai).
I'm stucked on the decision of buying the flat as the transaction has happened as shown below.
1. 1st Party (Scheduled Caste) --> Name of 1st Party is still there in Share Certificate
2. 1st party sold to 2nd Party in Open Category --> Name not in Share Certificate
3. 2nd Party sold to 3rd Party in Open Category --> Name not in Share Certificate
4. I'm willing to buy the flat from 3rd party --> I belong to Scheduled Caste
The society was not able to transfer the name of 2nd and 3rd party in Share Certificate and did not provide NOC as they belonged to Open Category.
Can anyone tell if I buy such property then the name transfer is possible on the Share Certificate ?
Need expert advice on what procedure to be followed to transfer the name from 1st owner (Reserved Caste) to my name (Reserved Caste).
What document will be needed at Social Welfare department regarding flat transaction and document required from the Society?
