Transfer of case

 

A FALSE CRIMINAL CASE U/S 156 (3) IS FILED IN AGRA IN 2005 MAKING RESIDENTS OF DELHI AS ACCUSED PERSONS.

NOW ALL ACCUSED HAVE BEEN ACQUITTED.

NOW ACCUSED ARE PLANNING TO HAVE LEGAL REMEDIES AGAINST THE COMPLAINANT FOR FILING FALSE CASE AGAINST THEM.

 SINCE ACCUSED PERSONS ARE RESIDENTS OF DELHI SO FILING CASES AGAINST THE COMPLAINANT IN AGRA WILL BE TROUBLE SOME.

IS IT POSSIBLE:

1. TO FILE PETITION IN SUPREME COURT OR ALLHABAD HC FOR SEEKING PERMISSION TO FILE CASE AGAINST THE COMPLAINANT IN DELHI OR GHAZIABAD (UP) . WHETHER SUCH PETITION IS MAINTAINABLE OR UNDER WHICH SECTION OF CRPC IT IS TO BE FILED.

2. FILE CASES AGAINST ACCUSEDS IN   AGRA AND THEN GO TO SC OR HC FOR TRANSFERRING OF CASE TO DELHI OR AROUND DELHI HAVING UP AREAS

U will have to file case in Agra itself.


Going to Allahabad HC or SC will be costly.

But first we need to know the full matter and what sort of case u want to file agaisnt the complainant.

Did he file any affidavit in the case or did he depose on oath, if yes, then u must file case u/s 340 CrPC

Case of defamation may also be a remedy but cant say for sure unless i know the facts

Accused can also claim compensation from complainant....
