Wife filed DV case u/s. 12 of DV Act
Ex party Order was passed on 20-9-2016 in favour of Wife
Husband disobeyed Order.
Wife filed Contempt Application against Husband u/s. 31 of DV Act .
On 5-12-2016 Magistrate issued B W .against Husband who was relived on bail on condition that he will comply with the ex party Order
Husband did not obey order hence NBW issued and Husband was arrested and released on bail on 03-02-2017 with direction to obey the ex-party in 15 days Order otherwise he shall be arrested and sent to Jail
Husband again did not obey order. Wife filed Application u/s.437(5) of CRPC and after issuing Notice and argument therein, the Magistrate passed Order dated 13-07-2017 and again directed Husband to obey the ex-party Order in 15 days otherwise he shall be arrested and sent to Jail
Husband filed 4 Appeals all u/s. 29 of DV Act and all are pending
1st Appeal against ex-party Order dated 20-9-16
Three Appeals against three Orders as above (Orders dated 5-12-2016, 03-02-2017 and 13-07-2017) passed in Contempt Application filed under Sec. 31 of DV Act
Now
1st Appeal is pending before Session Court -4
And other three Appeals before Session Court -6
Querry
Can wife file Transfer petition u/s. 408 of CRPC before Principal Session Judge to transfer three Appeals from Session Court -6 to Session Court -4 OR from main Appeal from Session Court -4 to Session Court -6 because all appeals are either against the ex-party Order in original DV Case or in the Contempt case which is the offshoot of the original DV Case
