The plight of hc bomb blast victims...

 

 

 

Delhi blast; Legal eagles defending terror accused sympathise with victims

They might be defending terror accused in various courts in the country but the legal eagles condemned the blast at the Delhi High Court on Wednesday.

Supreme Court lawyer Kamini Jaiswal, who defended Parliament attack accused Afzal Guru in various courts, said: “These attacks are cowardly attacks and I strongly condemned such attacks. I defended Afzal on the basis of the case law. He is just a client to me and our legal system gives equal opportunity to both the sides to defend in the court of law.”

Criminal lawyer KTS Tulsi, who defended Devender Singh Bhullar, who was facing death penalty for the car bomb attack in September 1993 that killed 102 people including former Indian Youth Congress chief MS Bitta in the Supreme Court, said:

“Fighting for our cases is a different issue and that does not mean that we support our clients’ action. It is unfair to equate the two.”

Lawyer Sanjeev Beniwal, who rushed his client Mehtab Singh, 55, to Ram Manohar Lohia Hospital, could not hold his tears back after doctors said Singh had succumbed to injuries.

“He [Singh] was fighting a property-related case at the court. He was getting his pass made when the explosion took place. His son Rohit and my associate Sachin Powa have also been injured,” said Beniwal, who was also injured in the blast.

Neeru Mahendra, wife of injured Pramod Mahendra, was seen running helter-skelter to arrange for medical aid for him at the hospital. He had gone to the court as our daughter Aarti Sabharwal is fighting a dowry case," Mahendra said.

People who got injured or faced death in HC bomb blast must be mainly litigants.They were already facing hardship in their life by struggling in these tiring court cases.There must be those victims also who must have faced some injustice.So they must have come to stand in those long queues to get inside HC,with a hope to get justice...which,in India, is more a matter of luck.


But they either died or got severely injured.


Now their families who are also facing court case related harassment face another ordeal,ie,death of an already unhappy family member(litigant) or severe injury of an already unhappy family member who's desperate to get justice.


If the person luckily survived,he has to now face 3 major hardships...

a)still struggling in the tortuous court case

 

b)struggling with his new painful injury/handicap as a result of this blast.going to courts in future in this handicapped/injured condition


c) postponement of the dates of his hearing in HC as a result of this blast...so more delay in getting justice

what a pitiable condition of these Indian litigants & their families!Their plight is really depressing....

While one's hearts goes to the victims and their families in their hour of deep pain and anguish, one would be ashamed to hear the justifications given by some of the Lawyers for defending those terrorists/criminals who were instrumental for  ruining lives of  hundreds of innocent victims and for causng untold miseries to thousands of their family members in particular and  for inflicting upon great harm to our Nation.  No doubt, our existing legal system allows equal opportunity to both sides to defend, but incidents like this happens one's conscience should not  allow one to defend such hardcore terrorists who committed heinous crimes without any kind of provocations for the same from the innocent victims !    Moreover,  it is  the need of the hour for the Lawyer community to strongly canvass their mite to get the existing law suitably amended, so that no Lawyer is permitted to defend those criminals who indulge into subversive / terrorist activities aimed at destroying our country.  Obviously, our soft legal system is also, to an extent, responsible for encouraging the terrorists to repeat targetting our country.  It is, therefore, that  stringent SPECIAL LAWS and FAST TRACK/SPEICAL COURTS  are inevitable to try and inflict instant rigid punishments on them.

No amount of justifications by such Lawyers will be acceptable to the familities of those who lost their bread-winners, near & dear ones.
