Terrace Ownership Rights

i need to ask a question.......i live in third floor nd when v bought flat..its was wriiten on registry tht terrace right is with all flat owners....bt other flat owners r misusing it....they r doing parties..they through their things roof...nd roof is in bad condition .....is there any method i can claim terrace cauz its also my roof...nd m suffering cauz of al others misuse..

all occupants are entitled to the usage of the terrace equally since its a common terrace. it appears that ur is the top floor. you could have purchased terrace also alongwith the flat. however, you could still negotiate with the society authorities and subject to consent of the members you could still purchase the terrace. However, the condition will be to allow others as and when they require it genuinely. You can also request them not to party on ur side's terrace as its endangering the safety of ur roof. you can resort to civil court in case they continue doing so.
