one of my relative's mariage in 2004 and he is facing 498a and others. Recently we came to know about TEP. Is it posible to file TEP now, and IT department wil acept it, and enquiry?

We want to file TEP against FIL for assesment year 04-05. I want to know that wil IT department reopen the 04-05 case. FIL has not filed any IT return, as per my knowledge. Can IT department take the action against FIL for 04 -05 casre and who is the authority for open the case of 8 years back accesment year.
Kindly suggest, what should i do.
