Summary suit

Can I institute a suit against the legal heirs of defaulting deceased sole propreitor ? the sole proprietorship firm is not in existences. and the account of the firm has been transferred by the brother of the deceased sole propreitor. I want to recover the money from the sole proprietor, can i go behind his legal heirs for the same ?

Yes u can file civil suit against him for recovery of money.that successor the assets of propiter then he is liable to discharge the debts.
