Stay order fro outside india

Hi 

 

I wanted to know few things about inherting agricultural property in Punjab.

My scenario: I am permanently settle individual in U.K. ( still Indian citizen by birth). I have a small protion of land which my father inherited.

I would like to file a case for my share of the inheritence.

Questions:

1. As i am living abroad, is there any provision stated in the consitution that I can get the stay order atleast from U.K. or do I have to travel to Punjab for that?

2. Also if I have to file a case, is it better to file it in the sub -divisional magistrates court (my village is near a tehsil) or I have heard of a NRI court (dont know much details about it) and is it feasible to file the case in NRI court in Jalandhar, Punjab?

 

I will be glad if some one could help me with these questions

you can give GPA (GENERAL POWER OF ATTORNEY)favg one of your close relatives  to handle all legal matters on your behalf,and it has to be probated, where the persons resides and ur property is situated. as far as court is concerned it depends upon the jurisdication.
