Stamp duty on land gift to town panchayat

We are a public limited company in Tamil Nadu, for the purpose of getting DTCP approval for layout we have to make gift some area of land to the local panchayat and the gift deed to be executed. For the registration of Gift deed should we pay 7% stamp duty? please clarify.

Stamp duty etc are state subject.

Handover the matter to legal cell of establishment.

They can approach a very able LOCAL senior counsel of unshakable repute and integrity specializing in revenue matters and well versed with LOCAL applicable rules/laws and having successful track record…. and worth his/her salt ………..with case file and discuss in person..

Such counsels have compilation of notifications and regularly visit revenue/concerned  office/officials an ascertain for said purpose 7% stamp duty is applicable or not.

Under which provisions of law, the Company is required to gift the land, for getting DTCP approval?

As per the norms of Directorate of Town and Country Planning, Chennai, Tamil Nadu, to get the approval for a layout of a land situated in a town panchayat, the applicant who applies for the layout approval should execute a gift deed in favour of the Executive officer of the respective town panchayat for the area of the road and area allocated for the open Space Reservation.

I have raised a question under Tamilnadu Stamp Act, 2013.  (Commercial Taxes and Registration Department of Tamil Nadu)

 Is stamp duty payable for the registration of Gift Deed with the Sub-Registrar in Tamil Nadu?
