Society Registration

Dear Sir,

Can a society be registred with out 60% occupancy? is there any Law that can be used for this.

Background of our case is. We have a building with A, B, & C. A & B  7 floors is residential wing with 36 flats and C wing is a 3 story commercial building.

Initially we files the documents for registring the society with 29 members for A & B wing since the builder was telling us that registration for commercial will be seperate. However the builder got the same rejected by the dy registrar on the pretext that C wing is also part of the same building and hence cannot be registred.

We again filed the ocument for registration including C wing since it had only 2 units as per the original plan (1 Hospital & 1 Bank). However again this time the builder got it rejected on the pretext of having 43 units in C wing ie he put partition inside and modified the plans. He also claims that he is constructing D wing in the place where we earlier had a garden (900sqft area only).

He is also creating proplems for flat owners by renting out the commercial wings to bachelors (100 - 150) people.

We have file a case for construction of D wing which is in City civil court and Aopeal for stay order in HC.

Is there any way we can form a society and get the conveyance.
