Section 44 of indian evidence act

Respected Gurus,

I have filed an evidence 44 petition as an IA in the current OP , my prayer is like I would like to nullify the decree which was earlier to this OP in the current OP as fraud played by my wife , but some how it was not numbered from the past 7 months , please advice me what to do ..
