Sec 9 and sec 13

I filed sec 13 in maharashtra after 6 months my wife put sec 9 in madhya pradesh My lawyer puts some kind of contradictory application but judge refuse that, and now the same lawyer told me if sec 9 was not in your favour then your sec 13 will be dimissed automatically please suggest me what will be the next as i am too much confussed in male biased law

Dear querist,

You have not mentioned sub section of section 13 Hindu marriage act.

There is no hard and fast rule that if your section 9 application will not fall in your favor then your application under section 13 Hindu marriage act will be dismissed. Everything depends upon merits of case.

Change your lawyer he is not giving you correct information.

There is no correlation between sec 9 and sec 13 petitions filed in different jurisdictional courts.

I filed sec 13 on the babsis of cruelity

But sir if suppose one of the court says you need to be stay together

and other one granted the divorce then what will happen

i mean whose order i will obey

Thanks a lot solama. Sir for your reply Sir is there a idol judgement or any case where that was happened please provide the same if any Or any rule because my lawyer still says the same thing
