Petition was filed in 2011 under companies act 1956 agaisnt oppression and mismanagement and order came from NCLT and same was held by NCLAT ordering the opresser to exit the company by selling shares to oppressed. Since companies act 2013 came to existance we are now unable to file followup remedy under section 406 and corresponding sections to recover the misappropriated amounts under the gusise of Salary, land sale agreements dividents etc. Pls advice. Can petiotion u/s 406 of companies act 1956 be filed now?
