Right of children of brother

G has four sons and a daughter namely A,B,C,D and E.

G died

B and his wife died leaving behind his son 'H'

C died bachelor leaving behind his self earned property

What is the right of A and E in the property of their deceased brother i.e. C.

whether H is also entitle to claim his share in the property of his uncle's i.e. C

1. Yes, the devolution of the property of the bachelor deceased son  C would devolve upon his mother and if the mother is not alive then you as the son of B can claim such share in the property in context along with the other brothers of such deceased son A & D and their sister.E  as they being the legal descendents of second class.

First right is of ClassI relations::::: Mother/Spouse/Children....

If ClassI relations are missing the ClassII relations will come into picture i.e:::::: Father,Brother,Sister,Sibling's son/daughter
