Removed existing boundary (stone) wall

There was a stone boundary wall on all four sides of my plot. Recently it was brought to my notice that the boundary on one side was removed and re-constructed moving the wall into my plot without my knowledge. My plot is vacant, I do not stay there. I tried to talk to the owner but he refused that the wall was reconstructed. If I move legally, do I have to file civil case or criminal case? The plot is in my younger sister's name who is not living in India, she has given me POA to take care of her land. If I file crimial case against the neighbor, will it affect my sister.

Let me know whats the best way to proceed in this case
