Y filed a suit for injunction against X. After 2 days Y filed a cr compplaint u/s 200 crpc in 506. The civil suit was filed to prepare a ground for cr complaint.Already there is FIR u/s 506(2) against Y on the complaint of X. The court summoned X for 506 IPC considering a prima facie case is made out. Where as it is a totally false case. The civil suit got dismissed for nor non appearence of plaintiff Y who didnot try to restore it and already more than 30 days have lapsed. Can X file a suit for malicious prosecution against Y . or what are the remedies available before X.
