one of my friend suffering following issues and asking me help.
1. In a criminal matter say like life threats, when police refused to register FIR .
the other remedy is to complaint before justice of peace and request him to order police to Register FIR. OR he hismself Register FIR on satisfaction.
2. In such Applications generally SHO and few police hierchy are Respondent.
3. The accused / offender is not made Respondent before J.o.P.
4. The complainant is not bound to make him Respondent. Becasue Justice of Peace is like a watching body on police action and ordering them to do legally.
5. Justice of peace if likes he can call Offender by him self or Police bring him. or offedender can sit and watch proceedings.
Complainant , action or the proceedings not illegal by not making him Respondent.
I think my friend is on legal track.
