whether the settlement deed is in pursuance of a court decree or its an internal understanding between family members?. The transfer should be by Deed of Release rather than a settlement deed by which she will release all her rights in favour of her son. Obtain a power of attorney of your husband. u will hv to get it stamped after being recieved in india. then his presence is not required.
