Refused life insurance cover for not providing aadhar

March 31, 2018 is currently the deadline to provide Aadhar after which it becomes mandatory. According to news reports from two days back, the deadline may still be extended further.

In this context, I have applied for a life insurance cover but the insurance company is refusing to process my application unless I give my Aadhar number. I already have my card but do not want to provide it unless it is made mandatory (which it is not now).

What are my options? Is it legal for an insurance company to refuse cover citing this as reason?

Assumptions apart and since you have posted that you do not wish to submit Aadhaar card:

Do you have copy of policy brochure, proposal form, enclosures filled, signed by you, acknowledgment of instrument of payment  and written communications supplied to you by insurer?

Do any of these contain any clause on having Aadhar card/mandatory submission of Aadhaar Card?

Did you answer in Yes/NO fr having Aadhar card?

Or declinature to process the proposal form is verbal i.e. in person and/or by phone calls?

You have the option to write to supply you authenticated copies of all of the above and status of issuance of insurance policy…

Let the insurer write back to you. Thereafter you can communicate in writing. The customer and policyholder should transact in writing and keep copies of all docs.

Even if IT is not legal the staff follows the SoP issued by establishment and insurer has to adhere to guidelines issued by regulator IRDA.

You may go thru the sequence of events;

IRDAI pushes back Aadhaar-insurance policy linkage deadline to March 31

https://www.businesstoday.in/current/policy/irdai-aadhaar-insurance-policy-linking-deadline-extension-march-31/story/266278.html

The Insurance regulator has notified all the policy offering organisations including the health insurance offering companies that the policyholders should submit Aadhaar and PAN only by March 31, 2018. Even for renewing the policy, the policyholders need not submit the Aadhaar card.

However there have been instances where health insurance offering organisations have asked for the 12-digit Aadhaar number. The news from the Insurance Regulatory Development Authority has bought in clarity in the procedure. As the last date is nearing soon, everyone is applying for an Aadhaar card to link their policies with it to avoid locking their policy.

IN case of policies existing in one’s name one may go thru;

Insurance Regulatory and Development Authority of India (Protection of Policyholders’ Interests) Regulations, 2017

and for corresponding year

THank you Mr. Kumar. I don't find anything related to Aadhar in the brochures. But today I asked for a written communication relating to this, and this is what I got in my email:

Sir as per the Under writing guide lines effective from Jan 2018 for all the new applications AAdhaar card is mandatory and without Aadhaar card the Application will not be able to process . For Existing polices company has given time till March 2018 .

Please help in getting your Aadhaar card copy or else Aadhaar acknowledgment copy (if you don’t have Aadhaar card) .

I understand that private organizations can decide on their own rules. But given that insurance is a government-regulated industry, is it legal for them to set their own rules and SOPs regarding Aadhar? Life insurance is a fundamental need and can I be refused one for not providing a document that is not considered mandatory?
