Refund of Stamp Duty

Dear all,

Can we claim for refund of stamp duty which has been paid extra by mistake. If yes then kindly provide me the judgement details or the provision in law that refunds the extra stamp duty paid by a company by mistake. The law must be binding in uttar pradesh.

I have not come across any such judgements, but you can apply for the same before the sub register to refund the extra paid stamp duty.

Q. How does one get a refund of stamp duty?

A. Refund should be claimed within six months from the date of purchase of Stamp. Refund is granted on spoiled paper, blank document or document executed but afterwards found to be unfit due to some mistake. An application ,should be made to Collector of Stamps.

I got a Lease document registered in 2007 and same ws admitted and registered. Now suddenly the dept has sought a notice that you have paid less stamp duty and demanding to pay the remaining? What should be the way out?
