Reasons for interim maintenance

What can be done if the Lower court does not find reasons for interim maintenance order u/s 24 HMA?

Does District& Sessions court/HC ignore this fact?

Is it true that the Lower Court is more powerful and its decisions are more respected than the HC judgements?

Agrieved parties  can go for appeal for higher courts.

if your interim maintenance is not granted with all the relevants documents with a stipulated time period you can go for appeal to the next best higher court or high court for same relief sort in the lower court

I modify my question. Adv K Mahesh answered from a different view.

 

It is a procedural question.

 

The lower Court did not take efforts to find sufficient reasons for ordering interim maintenance and did not mention them in the order.

 

What can be done in this case?

 

Do District & Sessions court and HC ignore this fact?

it is from your lawyer how much extra efforts he kept to grant interim maintenance means he should have highlighted to the court about the extra points

1. You have to state the entire facts of your case .

2. Maintenance is for whom for you or for your child .

3. Are you a working women or do you have a source of income . 

.4. On what grounds has the interim maintenance been rejected .

5. to appeal to a higher court you should have the order of the lower court .

If the District Court passed interim maintenance order without assigning the reasons, then the relief is that the aggreived party has to approach and challenge that order on the ground of non-speaking order and any other available grounds.
