Sale Deed violation in Apartments

Hi, I have bought an apartment in Bangalore. The apartment has been registered and ownership has been handed over. My apartment is on the first floor. The ground floor apartment owner has constructred a roof covering over his balcony area, which blocks my view to the common areas of apartment and also jeoparadises security to my apartment through the balcony. Sale deed clearly restricts any covering of balcony and construction of illegal structures in the apartment. Association is not yet formed and the builder denies his responsibility and asking us to sort out with the owner of ground floor apartment. The ground floor owner is not agreeing to remove the structure. What legal actions can i take in this regard?

1.you can claim your easement right in the court of law.

2. you can file a complaint before the local municipal corporation to demolish ill legal constructions.
