RTI to get FIR copy

Hi

How can i file RTI to get copy of FIR , I am based out of delhi and FIR is filed in Kerala. Do I need to send it police station or somewhere else.

 

Please gudie me in procedure for filing RTI it is an emergency

1. Please let me know when the police inform the person that there is a complaint against him, can that person be denied a copy of that complaint?

 

2. Please let me know under which section or law, the copy of the complaint can be denied to the accused?

 

3. Please let me know the designated officer to whom the accused can apply to in writing to get a copy of the complaint?

 

4. Please let me know if the accused can be denied a copy of the complaint before given his statement, byan or any information to the police?

 

5. Please let me know the action which can be taken against the Officer who refused to provide the copy of the complaint and to whom one should complain in writing regarding this matter?

 

6. Please provide the certified copies of the guidelines / official circular issued by you to your offices regarding the complaint copy matter.

 

7. Please let me know if the accused can be denied the complaint copy in English, official language of the country rather than the official language of the State.

 

8. Please let me know under which section or law, the copy of the complaint can be denied to the accused in English rather than the official language of the state?

It is submitted that the above information sought does not fall within the exemptions U/S 8 of RTI Act,2005 and to the best of applicant knowledge it pertains to your esteemed office in your statutory capacity as Public Information Officer u/s 5 (1) of RTI Act read with 5(4) and 5(5) of the RTI Act, 2005.

Can similar RTi for used to get details of investigation done and why police choose to ignore certain evidence which are given in written.

In order to get copy of the FIR, the RTI application has to be filed with Kerala police.

You      can     file    RTI    application     any   where    in   INDIA    before    the    any   PIO.   If    the    Information    sought    for   is   belong   to    other   Public   Authority......He    will   send   the    application   to   the   concerned   PIO   u/s   5    of   the   RTI   Act,2005     with   a   copy   to   the    applicant.

The RTI to get details of investigation should focus on documentary evidences that you need to obtain.

If your evidences were provided to police, you can also prove that by obtaining the same through RTI. That means, that if you seek the evidences available on record, you will get official copies of all evidences that they have on record. If you dont find the ones you had provided, then you can officially get the evidences filed again.

For evidences also, you can use the same basic format as suggested by a member above, just changing the questions according to what docs you want. You cannot seek opinion in RTI as to why they did not consider the evidence.

If your submitted evidences are already in their records, you can at a later stage in court, show their misconduct of ignoring the same. Even if they have charge-sheeted the case without considering the evidences, you can seek further investigation under S 173 (8) on the basis of your evidences.

As the matter is of different State, you can follow regular RTI process through registered post or speed post (trackable).
